Terms of Service

These Terms of Service ("Terms") govern your access to and use of Yamgi, a QR-menu platform operated by Emre Bal ("Yamgi", "we", "us"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.
1. The Service
Yamgi lets businesses build digital menus and catalogs, generate QR codes, customise their presentation, and view basic analytics. It is suitable for a range of businesses — such as cafes, restaurants, salons, hotels, and retail. Features may change, expand, or be removed over time, including optional AI-assisted tools for drafting descriptions, translations, and image handling.
We provide the service on a software-as-a-service basis. You are responsible for the devices, networks, and accounts you use to access it.
2. Accounts and eligibility
You must be at least 18 years old and able to enter into a binding contract to use Yamgi. When you register on behalf of a business, you confirm you are authorised to bind that business to these Terms.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly of any unauthorised use.
3. Subscriptions, billing, and renewals
Paid plans are billed in advance on a recurring basis (monthly or yearly) through our payment processor. By subscribing you authorise us to charge the applicable fees to your selected payment method until you cancel.
Selected paid plans may include a free trial period (currently a two-week free trial on the Pro plan). Unless you cancel before the trial ends, your subscription automatically converts to a paid plan and we charge the applicable fees to your payment method. Free trials are limited to one per customer and may be changed or withdrawn at any time.
Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time; access continues until the end of the paid period and we do not provide pro-rated refunds except where required by law.
We may change prices with reasonable advance notice. Continued use after a price change takes effect constitutes acceptance of the new price.
4. Acceptable use
You agree not to misuse the service, including by: uploading unlawful, infringing, or misleading content; attempting to gain unauthorised access to our systems or other accounts; interfering with the integrity or performance of the service; or using the platform to send spam or malware.
You are solely responsible for the accuracy and legality of the menu content, prices, allergen information, and images you publish.
5. Your content
You retain all rights to the content you upload (menus, images, business information). You grant us a limited, worldwide, royalty-free licence to host, process, and display that content solely to operate and provide the service to you and your end users.
You represent that you hold the necessary rights to the content you upload and that it does not infringe third-party rights.
Where you use AI-assisted features, the service may generate suggested descriptions, translations, or image edits from the content you submit. These outputs are produced automatically, may be inaccurate or incomplete, and are provided as drafts only. You are responsible for reviewing and correcting any AI-generated output — particularly prices, allergen and product information, and translations — before publishing it, and you remain solely responsible for the content you publish.
6. Intellectual property
The Yamgi platform, including its software, design, and trademarks, is and remains our property or that of our licensors. These Terms do not grant you any right to our branding except as needed to use the service.
7. Third-party services
The service relies on third-party providers for payments, hosting, storage, analytics, AI content generation, and map data. Your use of those features may be subject to the providers' own terms. We are not responsible for third-party services we do not control.
8. Termination
You may stop using the service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or where required by law.
On termination, your right to use the service ends. We may delete your data after a reasonable retention period as described in our Privacy Policy.
9. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total aggregate liability for any claim is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or your mandatory statutory consumer rights.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you by a reasonable means. The "last updated" date at the top reflects the latest version. Continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts of Istanbul, Türkiye have exclusive jurisdiction over any dispute, subject to mandatory consumer protections in your country of residence.
